21 year olds Nick Brumbley, Charlie Womble and 29 year old Rebecca Joy Francis tried buying alcohol but were turned down by the salesman because they appeared intoxicated.
Moments later, police believe their pick up struck Grady Anderson and his grandson, three-year-old Brady Singleton from behind.
"Yes, we feel that alcohol was involved," says Polk County Detective Kevin Cole.
All three suspects have been arrested and charged in the fatal hit and run Tuesday in Cherokee County.
The accident happened on a back road near Highway 68.
Anderson and his grandson were cruising when Brumbley's 1989 pick-up sent them careening off the road.
Anderson and Singleton fell into a creek.
The 4-wheeler landed on top of them.
Family members came to the accident site Wednesday.
"I'm glad they caught them," says Josh Raper, "and I hope they [law enforcement] push it to the limit on them."
"I just think it shouldn't of ever happened," says Charlie Raper, brother-in-law of Anderson.
His family says Anderson suffered severe head and back injuries. He's listed in critical condition at Erlanger Hospital.
Brumbley is charged with driving under the influence, felony hit and run and felony death by motor vehicle.
