Ft. Oglethorpe Council, Mayor Uphold Firings During Appeals

        Appeals for former Chief David Eubanks and former Public works director Jeff Long all came down to testimony from the interim city manager Harold Silcox.
     Silcox said he fired Eubanks because he left a meeting early, and didn't show up during a shooting at a mall, and a homicide at a hospital.
     Eubanks attorney Ken Poston argued Silcox wasn't informed enough to make that decision, and that Eubanks was still on medical leave for a stroke during the homicide.
    Attorneys even argued that Silcox shouldn't have been appointed as interim city manager on March 22nd, because Ron Goulart's resignation wasn't effective until March 25th.
      The council voted to uphold the two firings, and both Eubanks and Long have filed a lawsuit against the mayor, council, and Silcox.
     Attorney Stuart James says the appeals hearing only gave them more material to fight their case.
     "This is a means of discovery for us," said James, "We will use it as in the law suit.  We will use it in the discovery process, in the lawsuit and we'll continue to air this in the public light.
