California's Same-Sex Marriage Ruling and What it Means in the Tennessee Valley
On May 14th California's Supreme Court overturned a state law banning same-sex marriage.
Could that ruling have an affect here in the Tennessee Valley?
In a 4 to 3 split decision the California Supreme Court ruled the state's ban on same-sex marriage was unconstitutional...
San Francisco Mayor Gavin Newsom says, "And by the way as California goes so goes the rest of the nation."
Minister Jeff Briere of the Unitarian Universalist Church of Chattanooga says, "If the state is gonna be in the marriage business, they need to be in the marriage business for all the citizens."
Briere thinks gender or sexual orientation shouldn't shouldn't have anything to do with whether a couple can marry, "People that are upset by this will often say it threatens marriage. Well, it doesn't threaten my marriage."
Briere says same-sex marriage is a matter of justice, not faith.
He says most faith teachings about homosexuality and marriage are thousands of years old and no longer apply to the world today.
But not everyone agrees...
In a written statement Family Action Council of Tennessee President, David Fowler says "Marriage is not something we made up and can therefore redefine."
Fowler says marriage is between a man and a woman, and the Tennessee Constitution reads the same way.
Chattanooga Attorney J.B. Bennett says, "In TN we have an amendment already in our constitution to define marriage as between one man and one woman only."
The California Constitution does not contain this definition, and that's why the Supreme Court overturned the ban on same-sex marriage as unconstitutional.
Bennett says the California ruling has no impact on Tennessee Law.
The state does not recognize Civil Unions between gay couples, and due to the defense of marriage act, does not have to recognize a same-sex marriage from any other state.
Still, Briere says, that doesn't make it fair, "It's a good thing for people to be married. It contributes to the economy and the growth of the country."
A California coalition is collecting signatures to amend the state's Constitution to restrict marriage to a man and a woman only.
So far that coalition has more than a million signatures.
Clear
No one said "gay marriage leads" to anything. I said it opens doors to legalize things in this country that in turn would put a tail spin on the sanctity of marriage.
It's a choice the people should have, to vote to keep it safe.
Where you are confused, and
Where you are confused, and what many on the right choose to forget, is that marriage is a religious ceremony that has political and social ramifications. If a couple chooses to live together and commit exclusively to one-another in a loving relationship, then all of the social aspects of marriage should still apply. Ideas like power of attorney, inheritance, even insurance for a spouse are affected by marriage, but gay couples do not have the same benefits. My girlfriend and I are a heterosexual couple so being able to get married is not a problem. We are also both atheists so a wedding as a religious ceremony doesn’t appeal to either of us. However, it is important because of the social implications of marriage. I know that if either of us lost our job, the other would be able to get insurance coverage for both of us if we were married, whereas if we had been a couple for 20 years but couldn’t get or hadn’t gotten married, that would be impossible. If the title, “marriage” is so important, you can keep that. Just provide a secular alternative. We would be perfectly happy to live together in sin in the eyes of your god, so long as we were given the same rights and protections that marriage gives, only without the religious implications.
Correction
California constition in the family code section does define mariage as being between a man and a women. That is what the Supreme Court determined was unconsitutional language.
"308.5. Only marriage between a man and a woman is valid or recognized in California."

IT REALLY SHAMES ME THAT OUR LAWMAKERS THAT AMERICAN TAXPAYERS PAY ARE MORE WORRIED ABOUT MARRIAGE THAN THEY ARE THIS FALLING HOUSING MARKET, ECONOMY IS AT ITS LOWEST LEVEL, EMPLOYMENT DOWN, FOOD PRICES SKYROCKETED, GAS AT ALL TIME HIGH, WE HAVE TROOPS THAT ARE NOT WANTED IN A LAND WHERE AMERICANS ARE NOT WELCOME AND BEING INJURED ARE KILLED BY THE DOZENS, AND OUR SUPREME COURT SYSTEM IS MORE CONCERNED IF SOMEONE CAN GET MARRIED LEGALLY, THE PEOPLE ARE ALREADY LIVING TOGETHER NO ONE CARES IF ANYONE GETS LEGALLY MARRIED IS THAT UNDERSTOOD? NOW TO THE SUPREME COURT THE TAXPAYERS OF AMERICA ARE NOT GOING TO KEEP SHELLING OUT TAX DOLLARS TO YOU DEAD BEATS IF YOU DO NOT START DOING THE JOB THAT THE AMERICAN PEOPLE HAVE PAID YOU TO DO, THE WAY IT LOOKS THAT SEVEN SUPREME COURT JUDGES CAN NOT PERFORM THEIR JOB DUTIES CORRECTLY WILL BE IN THE UNEMPLOYMENT LINE, THAT IS THE BOTTOM LINE, BECAUSE AMERICA HAS FAR MORE IMPORTANT ISSUES THAN MARRIAGE OF ANY KIND LEGAL OR NOT, SEVEN JUDGES NEED TO LET THE TAXPAYERS KNOW A.S.A.P. SO THEY CAN HIRE THE CORRECT EMPLOYEES TO DO THE JOBS THAT NEED TO BE DONE!

The ruling was by California's STATE supreme court, not the federal supreme court.
Liberty for all
Three out of the four judges that ruled against discrimination and ruled in favor of same-sex marriage are Republicans. They are not the "far left political office holders" as one commenter above described. As far as the law is concerned, personal feelings aside, the is no justifiable reason for the State to not allow same sex couples from marrying. There is no evidence whatsoever that same-sex marriage has any negative effects on society at all. Comparing this to polygamy is silly and doesn't logically follow from this ruling.
Furthermore, civil rights should never be granted in a popularity contest. Women were granted the right to vote by the courts. Interracial couples were allowed to marry due to the courts. Schools were desegregated because of the courts. I can't think of any major civil rights movement that was decided by a popularity contest. Why is this true? Because minority populations would never get equal protection from injustices if it were up to a popularity contest.
No one is forcing churches to perform these marriage ceremonies. This case shows that liberty for all continues to march forward.
First of all, gay marriage
First of all, gay marriage does not lead to polygamy. Look at the polygamists in the news today. All heterosexual couples! If, however, you mean it could lead to greater tolerance and loosening restrictions that were enacted to further Christian principles, then yes, hopefully that will follow. I can’t understand why Christians take it on faith that same-sex marriage is a bad thing. Why not allow them to commit their lives to the one person they love like heterosexual couples can? I mean, half of all heterosexual marriages end in divorce anyway, so I’m not sure why this is such a scary thing for you. The only reason the bible condemns homosexuals is because homosexual couples can’t have children. If the couple can’t have children, then who are the Christians going to indoctrinate? That which is holy really boils down to that which furthers the interest of Christianity as a political movement, as true 2000 years ago as it is today. Homosexuality exists in many other species besides humans. That is to say, it occurs in nature, ergo it is natural! It isn’t a choice, it is a genetic predisposition. How do you know you are straight? Are you naturally attracted to members of the opposite sex or did you just choose that because the bible said so? Fear of others who are different is a fear that you are wrong. But that’s the thing, it’s just your warped view that tells you one is wrong and the other is right. It’s just about what is right for the individual and the rights of the individual. This country was founded as a haven free from religious oppression. Let’s keep it that way!

I'd hate to see that day!
Hopefully, if it ever comes to it, OUR politicians will put it to a public vote like Californian politians did NOT value. Oh, there was one, and majority/69% of voters in CA said "same sex marriage" is the only form of marraige they wanted for their state. But they were overruled by the far left political office holders. This can only open the door for legalized poligamy and group marraiges, etc.
Tennesseans should get ready. We may see the day, although our time should prove more beneficial than the other side of the country.
