A 70 year old man finds himself behind bars this afternoon charged with aggravated assault.
This after an incident at Wendy's in East Ridge Saturday afternoon.
Police say Ernest Cummings asked the restaurant staff to remove a patron he thought was making too much noise.
When management refused, police say Cummings got his gun and threatened employees.
He's charged with two counts of aggravated assault.
