Security Concerns Around Antea Mountain

More troubles on Aetna Mountain this weekend. Residents say a security service is now blocking the dirt road entrance up the mountain.

Property owners on Aetna have been battling a developer who is expanding a housing subdivision up the mountain. There have also been concerns about four-wheelers riding through the housing development to get to Aetna Mountain and leaving dirt on the road.

A court order ruled residents can use the easement to get to their property. But this weekend a private security service set up a road block. Property owners called police, and even captured the ordeal on their cell phones. But they say this only adds to on-going troubles.

“They don't want anyone in an off-road vehicle going up the mountain. And it's just an intimidation tactic,” said property owner Jeff Perlaky.

Perlaky says he plans to file a Contempt of Court, citing the court order that allows him to use Aetna Mountain Road.

I dont see how someone can be harrassed for using a public road. Even when state road blocks are set up there is some kind of public notice of it 1st. I could be wrong but seems like when there is going to be a road block it's on the news or in the paper or something 1st. And I dont understand about the no parking on the side of this public road either as long as the vehicle doesnt block the road then why does it matter. If a vehicle is parked on the side of a public road even a highway they put some kind of sticker on it and it's sits there with the sticker on it for at least 24 hours before it's towed. The Chattanooga police Dept. should be arresting the ones that are harrassing people for using a public road. I guarante you that If I stoped and harrassed every car that drove down a public road the police would be called and I would be asked to stop or go to jail ! Isnt that what some of our taxes are paid for the use of public roads ? I can see why this neighberhood would want to protect there homes and property theres nothing wrong with that but to do it to just harrass people for using a public road is just wrong ! Shouldnt matter if your in a Jaguar or a Jeep they should leave people alone for wanting to use a public road.

Have you seen the houses in that area?! They are the "Haves" and we are the "Have-nots", including you. The golden rule is that those who have the gold make the rules (or pay off politicians so they can break them).

It is in direct violation of the court order from August, 2010. It is very sad that the developers are bodly violating the court order. I will be seeking contempt of court charges. I have no choice. It is my only legal access to my property. I have been threatened by City of Chattanooga Police in the past (One of whom lives in the subdivision) for what trying to access my land? I obey the law and respect the home owners however the developers don't respect any of my rights! If they refuse to respect the court order they should suffer the consequences. Additionally, off roaders who park along the public road are ticketed. Just visit the same roads during the week and look at all the construction equipment, trucks with trailers and cars that park along the road. Many of which park in front of the No Parking At Any Time Signs which are posted. The City does nothing about the construction vehicles parked on the City roads. I have no problem with laws being enforced but do it fairly and equally. The City of Chattanooga does not have a good track record with being fair and equal when it comes to Aetna Mountain Road. The developers came in and obliterated my easement. In Tennessee blocking an easement is considered a tresspass. Did the develoeprs ever go to jail for this? Of course not. The police say it is a "Civil Matter" When the land was purchased by the developers it said, "Subject To Etna Mountain Road." They didn't respect that on their deed and now their is no respect for the court order!!!!
