Man sentenced to 20 years for Aggravated Assault – Family Violence

WHITFIELD COUNTY — A man has been sentenced to 20 years for aggravated assault – family violence.

According to the Conasauga judicial circuit, a Whitfield County jury has found Daivi Jonathan Triana-Fraire guilty of Aggravated Assault – Family Violence.

They say Triana-Fraire was originally indicted on one count of Aggravated Assault – Family Violence and one count of Simple Battery – Family Violence.

Prior to the case being submitted to the jury, the State entered a nolle prosequi on the Simple Battery charge. After deliberation, the jury returned a guilty verdict on the remaining charge of Aggravated Assault – Family Violence.

Evidence presented during the trial showed that on November 2, 2023, Triana-Fraire and the victim became involved in a domestic dispute inside their shared residence.

They say Triana-Fraire forced the victim out of the home by kicking her outside. As she attempted to re-enter, he repeatedly pushed her back before placing his hand around her neck and throat, causing the victim to fear she would immediately suffer a violent injury.

“Domestic violence is about power and control. Every victim deserves to know that when they come forward, they will be heard, treated with dignity, and advocated for. Strangulation is one of the most dangerous forms of domestic violence and is a significant indicator of future lethal violence. This verdict demonstrates that our community takes these crimes seriously and will hold offenders accountable. The Conasauga Circuit District Attorney’s Office will continue to prosecute domestic violence offenders, stand beside victims, and seek justice on their behalf. We hope this verdict reminds every victim that they are not alone and that help is available.”

Following the verdict, the State requested the maximum sentence authorized by law. Judge Minter sentenced Triana-Fraire to 20 years, the maximum sentence allowed for the offense.
