District Attorney Neal Pinkston not Recused in Burns Case

CHATTANOOGA, Tenn.(WDEF)- Gatlinburg Detective Rodney Burns Case did not get what he wanted in the courtroom of Judge Tom Greenholtz this morning

Burns is being charged with perjury after he was investigated by the TBI for his testimony during the hearing for the adults involved in the Ooltewah rape case.

Burns wanted District Attorney Neal Pinkston recused from the case because Pinkston is the subject of a civil suit from Mr. Burns for defamation.

This morning Judge Greenholtz ruled that the District Attorney does not have to recuse himself.

They have not yet set a date to return to court.
