Judge orders new trial for two most serious charges against Justin Whaley

CHATTANOOGA (WDEF) – A judge has ordered a new trial for Justin Whaley on the two most serious charges against him.

He is the former EMT who was convicted of being drunk when he ran into another vehicle, killing a man six years ago.

Since his conviction, Whaley has been asking a judge for a new trial based on questions about the police officer who handled the blood evidence against him.

Two fellow officers accused him of inappropriate conduct in another case that was not made available to the defense.

His attorney says he would definitely have brought up the accusations at trial if he had known about them.

The judge ordered a new trial on the vehicular homicide and D-U-I counts.

But the convictions on the other five counts remain.

At his next hearing in August, they will pick a new trial date for the vehicular homicide and DUI charges.
