Ooltewah coach Andre Montgomery asks judge to throw out the case against him

CHATTANOOGA (WDEF) – The day after three of his former players were convicted in the Ooltewah rape case, former basketball coach Andre “Tank” Montgomery faced a judge himself.

He faces four counts of failing to report child sexual abuse.

On December 22nd, Gatlinburg Police say three teenagers assaulted a freshman with a pool cue while the team was staying in a cabin awaiting tournament games.

Montgomery and his attorney were trying to have the charges thrown out.

The arguments in court surround the new Tennessee law that requires reporting of such incidents.

But Montgomery argues he met the requirement of a vague law.

After hearing from both sides, Judge Poole postponed ruling on the motion until the Tennessee Attorney General can weigh in on the law.

So he scheduled another hearing for October.
