Private Property Coalition files lawsuit over Chattanooga STVR ordinance

CHATTANOOGA, Tenn. (WDEF) – A group of private property owners have filed suit against the city of Chattanooga.

Attorneys Brian Boyd and Bennett Willis are representing the Greater Chattanooga Coalition of Private Property Rights.

They are suing the city over a recently enacted ordinance that designates where these short-term rental properties can operate.

In the lawsuit, the plaintiffs allege multiple Constitutional violations.

These include not being able to place signs on their vacation rental property, differing fees based on the type of vacation rental and if the owner lives in the home.

Attorney J. Drew Clements of Tom Bible Law Firm said, “I don’t see the parties necessarily figuring this out in maybe a mediation. I would think this is something where you see a judgment being entered on this just because of some of the Constitution law implications there. I think the city may want to have something definitive there backing them up or telling them what they need to do to revise this.”

The attorneys for the plaintiff nor the city have elected to comment on the lawsuit.

The suit was filed in Hamilton County Chancery Court.
