Prosecutors drop DUI charged against truck driver in I 59 fatality

TRENTON, Georgia (WDEF) – A Pennsylvania truck driver has one less charge after a preliminary hearing in Dade County.

Gustavo Rodriguez-Pagan was charged with vehicular homicide and DUI after a crash on November 16th.

It was one of a cluster of serious wrecks on I 59 & 24 around Thanksgiving.

The driver of another 18 wheeler was killed in that crash.

One of the reasons Rodriguez-Pagan was charged with DUI was he was walking around without a shirt after the wreck in cold weather, and could not give a good account of what happened.

But in court on Wednesday, a toxicology report found that there were no drugs or alcohol in his system at the time.

The Dade Planet reports that the Prosecutor dropped the DUI charge, but kept the more serious vehicular homicide charge.

However, he changed the basis for it to reckless driving instead of intoxication.
