Robin Smith filing challenge to Democratic lawsuit
CHATTANOOGA (WDEF) – The legal wrangling over whether Republican Robin Smith should be on a state house ballot continues, even after she won a primary vote.
The Hamilton County Election Commission certified the August 2nd results on Wednesday.
But the state democratic party continues to challenge whether she should have been allowed on the ballot.
She replaced incumbent Gerald McCormick, who withdrew late in the race.
Several courts have rejected the democrats calls to intervene in the primary vote.
But the state party continues to file appeals.
So Smith today directed her attorney to file a motion to intervene in their latest legal challenge.
She argues that if a court throws her off the ballot now, they will negate the votes of the 7,767 people who voted for her in the Republican primary.
“By continuing this farcical legal action, the Tennessee Democratic Party has demonstrated its priority of securing an opponent-free election for its nominee, a self-described socialist, over any consideration for the voters of Hamilton County.”
