Justin Whaley is asking for bond while he awaits a new trial on vehicular homicide
A judge ordered a new trial based on questions raised about the Soddy Daisy police department
CHATTANOOGA (WDEF) – A former Hamilton County E-M-T who has recently had his conviction overturned in a deadly 20-18 crash was back in court this morning.
Justin Whaley had been convicted of vehicular homicide by intoxication in the death of James Brumlow in a wrong-way crash in Soddy-Daisy last October.
However, Hamilton County Judge Boyd Patterson recently ruled due to the Soddy-Daisy police officer who detained Whaley right after the crash not disclosing he was the subject of an internal affairs investigation, that Whaley has the right to a new trial.
Despite his primary convictions being overturned, one felony and several misdemeanor convictions are still intact against Whaley, leaving him behind bars.
However, his attorney argues that Whaley should get a new bond.
“So the predicament we find ourselves in, he’s been in custody since October. He would come up for parole on a C felony around November for a first consideration of parole. The misdemeanors will have been served by October.”
There has additionally been a federal lawsuit filed against the Soddy-Daisy Police Department in relation to the non-disclosure of that internal affairs investigation.
