Allegations of rape vs. allegations of a sexual threesome; which is the truth?

SODDY DAISY, Tennessee (WDEF) — While a man sits in jail on a $105,000 bond awaiting his arraignment on a charge of rape, his family is claiming he was wrongfully accused.

“We had a female a 17-year old female actually, came here to the police station.  She alleged of a sex crime that had been committed on her,” said Soddy Daisy Police Lieutenant Jeff Gann.

According to the victim, that sex crime was committed by Daniel Mears,18, of Soddy Daisy.

The victim told police she was sleeping in an outbuilding located behind a home on Springfield Road. She said she had awaken from sleep only to find Mears sexually assaulting her. She then said he jumped off of her after her boyfriend walked in.

“I can’t image what she’s going through, but to be able to have the courage to walk in here and be able to state exactly what took place at that time is just phenomenal,” Gann said.

According to police, Mears admitted to the events reported by the victim and he was later charged with rape, but several of his family members are saying he never raped the girl.

“This girl never seemed in harm. I know that it was a thing with all three,” said the suspect’s aunt who asked not be identified.

The aunt said she was one of multiple family members at the home on the morning of the alleged incident. The aunt said her her nephew, the 17-year old girl and the girl’s boyfriend had come out of the outbuilding bragging about having a threesome.

“The boyfriend is the only one that actually performed. Because the boyfriend didn’t want Daniel to be judging the girl he told Daniel to touch her and he did the rest. I know that because he was bragging about it in our backyard and I’m not just saying that because he’s my nephew,” she said.

“That girl came out the building to go use the bathroom and when she came out, she looked at me and grinned. Then she turned around and locked the door behind her. Daniel told the law the only thing he did was touched her,” said the suspect’s brother.

The arrest affidavit does not mention any statements made by the victim’s boyfriend.  That’s not the only lingering question to this story.

Why was a 17-year old girl sleeping in an outbuilding on the family property of the 18-year old accused of raping her,  instead of home getting ready for school?

And why are adult relatives relating stories about teenagers bragging openly to other relatives about sexual threesomes?

It’s also worth noting that News 12 has confirmed the alleged victim has a relative who works for the Soddy Daisy Police Department.
