Chattanooga man arrested for rape while attending a party

CHATTANOOGA, Tennessee(WDEF) – What started as noise complaint to police quickly turned into a rape investigation when officers arrived on scene.

Charles Penney Jr., 40, of Chattanooga was arrested and charged with one count of rape.

The alleged incident happened during what police describe as a large party on New Years Day.

According to the arrest affidavit, officers were responding to a noise complaint at a residence in the 300 block of Cross Creek Drive. But when officers arrived on scene, several people reportedly told them a woman at the party had been raped.

Two witnesses told police they caught Penney in the act and asked him to leave the room  where the alleged incident took place.

According to the affidavit, the victim was passed out during the incident and told officers she didn’t remember anything.

According to Hamilton County jail officials, Penney is now out of jail on a $35,000 bond.

His next court date is January 8.
