Judge: Gov. Kemp must testify before grand jury in election interference probe

Fulton County Judge Robert McBurney writes in response to Kemp's motion to quash the subpoena that Kemp will testify after the midterm election

ATLANTA (WDEF) – A Fulton County judge ordered Georgia Governor Brian Kemp to testify in front of a special purpose grand jury regarding the state’s election interference.

But, in a victory for the governor, he will not have to do so until after the midterm election.

In the judge’s response to Kemp’s motion to avoid testifying, Judge Robert McBurney says Kemp is not complying with the subpoena, citing immunity relating to his position as governor.

McBurney writes he cannot do that with no lawsuit pending.

Prosecutors want to ask Kemp about contact he had with President Donald Trump and others in the aftermath of the 2020 general election.
