Hamilton Co. BOE named in lawsuit about Ooltewah assault

CHATTANOOGA, Tenn. (WDEF) – The family of the victim of the Ooltewah basketball assault filed a lawsuit in United States District Court for the Eastern District of Tennessee Chattanooga Division.

It’s the result of an assault that occurred during a tournament in Gatlinburg last December.

The three suspects in the Ooltewah rape trial were found guilty last month in connection with the rape of a basketball player.

Two juveniles and a player who has turned 18 were tried in Juvenile court in Sevierville.

None of them have been publicly identified, but investigators have pointed the finger at the 18 year old as the instigator.

Evidence and initial testimony showed that the students assaulted a 15-year-old player with a pool cue at the resort cabin where they were staying.

The plaintiffs are identified only as John and Jane Doe to protect the anonymity of the underage victim.

The defendants are listed as the Hamilton County Board of Education, d/b/a Hamilton County Schools, James Jarvis, both individually and as an agent of Hamilton County Schools, Jesse Nayadley, both individually and as an agent of Hamilton County Schools and Andre Montgomery both individually and as an agent of Hamilton County Schools.

Friday evening, a joint statement from Hamilton County Board of Education Chairman Rhonda Thurman and Interim Superintendent Kirk Kelly was released.

It reads:

“The Hamilton County Board of Education has received a copy of a lawsuit filed today against the Board, Jim Jarvis, Jesse Nayadley, and Andre Montgomery. Providing a safe, secure environment for all of our students continues to be the top priority of our school system. Since this matter is now the subject of litigation in federal court, we cannot comment further.”
