Rossville woman charged with criminal exposure to HIV

CHATTANOOGA, Tennessee(WDEF) – A convicted prostitute with a criminal rap sheet nearly three pages long has been arrested for allegedly spreading HIV on purpose.

Janet Diane Schmitt, 48, of Georgia was taken into custody by Chattanooga Police and booked into the Hamilton County Jail on Saturday.

Schmitt has been charged with three counts of criminal exposure to HIV, assault and theft.

The alleged offenses occurred back on April 24.

According to the arrest affidavit, Police were called to the Walmart on Cummings Highway to respond to a shoplifting incident involving Schmitt. A store manager told police, Schmitt attempted to steal $180 worth of various meats.

According to the arrest affidavit, Schmitt told three Walmart employees she had AID’s before coughing and spitting in their face and then telling them,”No you have it!”

According to Hamilton County court records, Schmitt had been arrested and convicted for prostitution four times since the mid 1990’s. Court records also show that Schmitt has multiple convictions for burglary.

Her next court date is Thursday May 12th.
