TBI shows dramatic increase in “sober” DUI arrests

These are cases where you are charged even though blood tests come back negative

NASHVILLE (WDEF) – The TBI has issued new data on people who have been charged with DUI but didn’t test positive for alcohol or drugs.

It shows a big increase in these cases over 2024.

Nashville media have reported over the last few years on suspects who have endured driving punishments and insurance fallout only to be cleared in court.

The problem got enough attention that lawmakers passed a bill last year requiring the new reporting.

The TBI reports 419 cases of the so-called “sober arrests” in 2024.

In our area, the Tennessee Highway Patrol had the most “sober arrests” at 17.

Police and troopers are allowed to charge a driver with DUI even if you do not test positive for alcohol or drugs.
They are trained to spot signs of impairment and can make that judgement call.
The TBI notes that not all drugs that can impact your driving ability are covered in blood tests.
