Judge refuses to dismiss extortion charge against Tim Boyd

CHATTANOOGA (WDEF) – The attorney for Commissioner Tim Boyd asked a judge today to dismiss the extortion charge against him.

The Hamilton County Commissioner was charged for phone calls he made to political opponent Brent Lambert. Lambert released the tapes to the media.

Prosecutors said Boyd told Lambert that if he would not drop out of the race, his campaign would release damaging information on him.

But Boyd’s attorney argued that it was an issue of political free speech.

But D.A. Neal Pinkston says there is no mechanism to dismiss this case, like there is in civil court. He says it will be up to a jury of Boyd’s peers to decide if it is extortion and not a motion.

Bradley County Judge Andrew Freiberg was brought in to hear the case.

He denied the Boyd motion to dismiss.

Both sides will return to court for another hearing on August 9th.
