Cortez Sims in Court
CHATTANOOGA, Tenn. (WDEF)- The motions hearing for Cortez Sims continues today in court; this is the man accused of shooting four people, and killing one back in January of 2015.
Cortez Sims is facing several charges including first degree murder, after he allegedly shot and killed a 20-year-old woman, while injuring three others, including a one-year-old girl, her mother and an 18-year-old man.
The toddler was paralyzed after the shooting, and her mother, Bianca Horton testified against Sims in a hearing earlier in the case.
But more than a year later, Horton was found dead.
So Sims’ attorneys filed a motion to keep prosecutors, and witnesses from discussing her death during the trial, for fear it could sway the jury’s decision.
The defense also filed a motion to have video from the body camera worn by the officer who interviewed Horton that night, but the judge denied both.
“I think it’s very important for the jury to hear what she actually said there on the–on the video, which is admissible because it’s an excited utterance, but also uh goes to the probative value of the entirety of the uh recording.”
Sims is expected to be back in court February 16th for another motions hearing.
The trial will begin April 4th.
