Judge dismisses charges against Ooltewah basketball coach
CHATTANOOGA (WDEF) – Charges were dropped against former Ooltewah High School head basketball coach Andre Montgomery.
Earlier this year, he was charged with four counts of failure to report child sexual abuse.
This stems from an incident in Gatlinburg where a basketball player was raped with a pool cue by fellow teammates.
This morning, Judge Don Poole dismissed all charges against Montgomery.
He said Montgomery was only required to report the abuse if it was done by a parent or guardian.
Defense Attorney Curtis Bowe told us “The statute’s pretty clear. I think Judge Poole in his order actually commented on that, and it says what it says and in reading the statute, it’s how it’s put together, and what the definitional sections apply to. And as a result, he dismissed it, because in this instance, the duty to report, as he put in his order, was not present here because those folks weren’t parents, guardians, carekeepers.”
The prosecution is looking into an appeal.
