Judge dismisses charges against suspect in Soddy Daisy case that spawned complaint against her

CHATTANOOGA (WDEF) – A Soddy Daisy man was arrested in January for shooting at a man and his pregnant girlfriend. Coty Wamp serves as the Hamilton County Sheriff’s Office Lead Counsel. She says she learned Soddy Daisy Police may have arrested the wrong man. She claims she felt ethically bound to speak with the victims herself.

“I had a feeling that it was in fact the wrong person at the jail. But that wasn’t my concern. I was just connecting victims to the right law enforcement agency,” says Wamp.

Wamp says she contacted the Soddy Daisy Police and the District Attorney Neal Pinkston’s office to let them know her findings. Wamp happens to be running for D.A. against Neal Pinkston. Pinkston later accused Wamp of witness tampering in the case and asked the TBI to investigate her.

“Elected District Attorneys across the state have the privilege of being able to request TBI investigations. To use this privilege as a political weapon, asking for an investigation into your own political opponent is not only an abuse of power, it is a disservice to the office you hold and to those who elected you,” says Wamp.

Tuesday night, Soddy Daisy Judge Marty Lasley under advice from the Nashville D.A. and the T.B.I. dismissed all charges against the man who was arrested.

“To sort of see justice last night and to see Mr. Garcia Padilla be able to walk out of there without assault charges pending against him when he was the wrong person incarcerated is a victory for everybody,” says Wamp.

News 12 is waiting for confirmation on the status of the TBI investigation of Wamp following this turn of events. District Attorney Neal Pinkston did release the following statement saying in part, “The Hamilton County sheriff and the board of professional responsibility agreed with my decision, yet ultimately the decision is mine.”
